‘Ik ben toch niet God?’ Dit artikel legt de analyse van Paul Scholten over de werkwijze van een jurist naast de werkwijze en werkomstandigheden van een medewerker asiel van de Nederlandse Immigratie- en Naturalisatiedienst. De auteur concludeert dat het werken in de Algemene Asielprocedure beperkingen aan de medewerker oplegt die maken dat zorgvuldig en onpartijdig werken en het toepassen van de menselijke maat in het gedrang komen. Het werken onder tijdsdruk en met een complex juridisch regelstelsel dragen hieraan bij. Hierdoor (...) ontstaat het risico van robotisering van het beslisproces. Background: Nursing Ethics has featured several discussions on what good care comprises and how to achieve good care practices. We should “nurse” ethics by continuously reflecting on the way we “do” ethics, which is what care ethicists have been doing over the past few decades and continue to do so. Ethics is not limited to nursing but extends to all caring professions. In 2011, Elin Martinsen argued in this journal that care should be included as a core concept in medical (...) ethical terminology because of “the harm to which patients may be exposed owing to a lack of care in the clinical encounter,” specifically between doctors and patients. However, Martinsen leaves the didactical challenges arising from such a venture open for further enquiry. Objectives: In this article, we explore the challenges arising from implementing care-ethical insights into medical education. Research design: Medical education in the Netherlands is investigated through a “care-ethical lens”. This means exploring the possibility of enriching medical education with care-ethical insights, while at the same time discovering possible challenges emerging from such an undertaking. Participants and research context: This paper has been written from the academic context of a master in care ethics and policy. Ethical considerations We have tried to be fair and respectful to the authors discussed and take a neutral stance towards the findings portrayed. Findings: Several challenges are identified, which we narrow down to two types: didactical and non-didactical. Discussion and conclusion: In order to overcome these challenges, we must not underestimate the possible resistance to a paradigm shift. Our efforts should mainly target the learning that takes place in the clinical phases of medical training and should be accompanied by the creation of awareness in healthcare practice. (shrink)

Plurality of concepts of identity, foundational identity, and dualism This paper defends three claims. One: the Dutch word for ‘identity’ (viz. ‘identiteit’) is used to express very different concepts, such as the concept of ‘character’, ‘self-image’, ‘social identity’, ‘narrative identity’, and ‘identity through time’. Two: each of these concepts is applicable to human persons, but the concept of ‘identity through time’ is, in a crucial respect, more fundamental than the others. This article is essentially a commentary on a little-known text by `Alain' (whose real name was Emile-Auguste Chartier), successively entitled Les marchands de sommeil and Vigiles de l'esprit. This piece of work, initially a prize-giving speech to students in a Parisian lycée, was rewritten by Alain many years later during the Second World War. It describes with acute intelligence and in a splendid metaphoric language the enduring and compelling proposition that the formation of critical judgement should be the ultimate purpose (...) of all teaching. The Calvinist minister Godfried Udemans is generally considered to be one of the more important seventeenth-century theologians from the province of Zeeland. He specialized in writings for a broader public, including, in particular, publications on ethical and religious codes in trade and seafaring. Of his various writings on moral theology, 't Geestelyck roer van 't coopmans schip, first published in 1638, is the most important.The Spiritual helm appeared in print some thirty years after Grotius occupied himself with De jure praedae (...) , but Udemans had already begun articulating his thoughts in 1608. It is instructive to examine the ethical writings of a contemporary of Grotius. It has been claimed that in the early modern period, Calvinism, especially in its English Puritan variety, did much to propagate the medieval traditions of holy war that to all appearances had been laid to rest by Spanish theoreticians during the sixteenth-century Renaissance. In this article, I examine the extent to which Udemans draws upon religion as a means of legitimizing violence on behalf of secular political authorities such as the prince , and, more in particular, the Dutch East India Company and West India Company . If Udemans is representative of the religious tradition to which he reckoned himself, holy war thought did not figure prominently in Dutch Calvinism. (shrink)

Leibniz regarded the onomatopœia as the relic of the original and universal language: the language of Adam. He regretted the loss of that „lingua adamica”. This leads to a certain tension between the universality of a new logical language and the specificity of onomatopoeic utterances. This line can also be detected in more recent studies. The most important method of the experiential sciences is the so-called scientific induction, viz. the method that starts from the observation of the particular and individual and tends to obtain abstractly-general or universal statements. This article explains that such a progression from the individual to the universal can only be accounted for if it can be considered as an application of some general intellectual insights. As to the main feature, this application can be made explicit by means of the following (...) deductive syllogism : Maior : Whatever happens with regularity in the material world happens of necessity, i.e. by virtue of the proper nature of things. Minor : Now an investigation of the data of experience shows that a phenomenon of species A is regularly connected with a phenomenon of species B. Conclusion : Therefore, a phenomenon of species A is necessarily connected with a phenomenon of species B. The minor of this syllogism gives the result of the empirical research and this way of acting has to be accounted for by a critical investigation of the general methods used by physical science, the so-called methods of Stuart Mill . The foundation of the maior is given in section 4. It appears that this principle presupposes the absolute validity of the law of causality and, moreover, the determinism of the material nature. A few remarks are added concerning regularity and probability. The various individual instances which are the starting-point of scientific research are supposed to be the representatives of a certain species. This amounts to the supposition that there is a certain species-individual-structure in the material things. This problem is treated in section 5. In order to arrive at a general statement about a certain kind of phenomena it will usually be necessary to combine experiential data obtained at different times and places and in different individual circumstances. Such a procedure is based upon the general presupposition that nature is uniform. This general presuppositions implies in particular two presuppositions concerning the irrelevancy of time and place. These questions are dealt with in section 6. Finally in section 8 a few remarks are added concerning character and value of the general conclusions obtained by scientific induction. (shrink)

Four paradigmatic views on the task of the philosophy of religion are presented. The first is elaborated by a close reading of the first article of St. Thomas’ Summa Theol. The second paradigm is discussed by considering the ambitions of deism . The transition to the third paradigm is made by contrasting two works of David Hume. His Dialogues concerning Natural Religion fight the deistic idea of a natural religion on its own terms. His Natural History of Religion steers an (...) altogether different course by seeking to uncover the origins of religion in human nature. The fourth paradigm is illustrated by the neo-wittgensteinian tradition in the philosophy of religion. The rather objective grammatical inquiry of religious concepts that this tradition stands for, turns out – unexpectedly – to reconcile people to religion. (shrink)

The article deals with the classical idea that God's will is the foundation of moral obligation. The particular theory should be understood as a theory of a certain moral practice. Therefore, its 'Sitz im Leben' is first invoked by means of an episode of Walter Scott's The Heart of Midlothian. Then a strong version of the theory is stated and defended against a couple of current and classical objections. A successful defense would give rational support to the theory, but it (...) would not qualify the theory as the best in the field. That depends on the quality of its rivals. One of those, Christine Korsgaard's recent impressive Kantian reflective endorsement view is discussed. The conclusion is that it does not provide stronger grounds for the reality and inescapability of moral obligations than the divine command theory. (shrink)

Functions of type n are characteristic functions on n-ary relations. In Beyond the Frege Boundary [6], Keenan established their importance for natural language semantics, by showing that natural language has many examples of irreducible type n functions, where he called a function of type n reducible if it can be represented as a composition of functions of type 1 . We will give a normal form theorem for functions of type n , and use this to show that natural language (...) has many examples of irreducible type n functions in a much stronger sense, where we take a function to be reducible if it can be represented as a composition of functions of lower types. Recently the English scholar Heather McKay defended the thesis that before the third century CE the synagogue had never been a place of sabbath worship. In this article the author reviews all the material presented by her, adds some new evidence, and comes to the conclusion that the evidence points to a situation in which already before 70 CE the synagogue served as a place of sabbath worship.
